This legal agreement is made between you (Legal or sole proprietor), later noted as «right buyer», from one side and PhotoExposition company website from other side, which represents the interests of photo artist Zoriy Fine, who is noted later as «right holder».

You agree that payment is a full and non-discussed acceptance of the terms of this agreement.

According to the information above, please read the text of the agreement, and if you are not agree with any of the agreement’s terms, do not make a payment.

Materials (artwork) – objects of author and author-combined rights for photo materials.

Material file – electronic for, which contains the separate material (image), which can be used for professional use.

CD Collection – finished collection of materials, that contains files, ready to be professionally used and recorded to the storage and transfer device (CD-ROM).

Rights buyer – legal or sole proprietor, which is interested in buying rights for usage of materials for personal needs or by request of the client from the Rights Holder (to create advertising or other materials directly for the client).

Right Holder, based on the conditions, stated in this agreement, gives Rights Buyer or the client of Rights Buyer (the end user) in case if you are acting representatively of your client’s needs, not exclusive, non-transferable and not-yieldable right for limitless storage and use (reproduction) of materials.

Rights Holder gives the Material File or CD Collection, which can be used for professional use after the payment for the rights, and shipment charges for CD Collection.

Right Buyer gets rights to use materials in any commercial and non-commercial projects (including, but not limiting to): advertising material, reports, brochures, booklets, presentations, video and multimedia software, package materials, books, magazines, as well as using materials on webpages and web and Internet advertising. Rights are given for limitless time period without any limit for publish quantity.

Right Buyer receives the right to store and install the copy of materials of separate material files on the storage devices (for example, on web server or any mass storage device), used exclusively in the limits of local network of the Rights Buyer’s organization. All equipment, providing the access to materials, has to be in one place and work inside of one organization.

Rights for usage are being transferred only regarding the particular Materials, which are being bought by the Rights Buyer and only in case of payment. No other rights, except the right for material usage, as parts of end product or design, are not transferred.

Copy, spread and make accessible the copies of the files with images, design and (or) website, documentation and packaging.

Transfer rights to others, sub license, transfer license, sell, rent, license materials and (or) their files.
Use materials for any type of pornography, disinformation and misinformation, by trying to lie or hurt the author or use it for any other unlawful actions.

Use materials, containing logos and trade marks without getting permission of logo or trade mark owner.

Use materials as part of trade mark or company’s image.

Separately use people’s pictures, separating them from the group that consists of more than 4 people.

Use calendars, postal cards and post cards, posters and reproductions in design.

Publish images, design and (or) website in the network, e-post boards or news systems (news lines). Put images, design and (or) website in interactive environment in the format, suitable for being downloaded by other people, so it becomes commonly accessible.

Rights Owner guaranties, that being a person that is rightfully an owner of the artwork or author-right organization, which represents the author’s interests and other right owners, for the management of their owners rights.

Rights Owner guaranties, that all people who are used in the images, design and (or) website have given their permission to use their picture, but the use of these images, design and (or) website can only be limited to the agreement made.

Rights Owner does not give any rights or guarantees for usage of names, trade marks, logos, designs and artwork, registered or protected by the author rights, in any materials.

Rights Owner guarantees, that material files, or CDs do not contain damaged images, design and (or) website and are eligible for 90 day exchange from the date of purchase.

Images, design and (or) website are presented «AS IS» without any direct or indirect guarantees.

Rights Owner does not give any quality guarantees for images, design and (or) website or compatibility with any other computer hardware (or software). The responsibility of Rights Owner is being limited on exchanging the CD, file or refunding the money.

Rights Owner, website PhotoExposition.com, are not responsible for any damage, direct or indirect, coincidental or intentional, which happened in result of this agreement, including the damage from loosing the profit or any complaints from other sides.

All materials, which are being affected by this agreement, are protected by international copyright laws and international agreements laws. Materials and software (CD Collections) should be treated as any other material, which is affected by copyright laws.

Copyright on materials that are affected by this agreement are not sold. Rights Owner reserves the rights that are not being mentioned in this agreement.

Rights Buyer hold all the responsibility for any actions of breaking the rules of this agreement, when the reason for that is that you have not obeyed the rules of the agreement. If one of the rules of this agreement will not work, all others are still should be followed.
